OFFICIAL SWEEPSTAKES RULES
NO PURCHASE NECESSARY TO ENTER OR TO WIN
(1) ELIGIBILITY:
The Cindy Diane "Face To Face In The Beautiful Bahamas" Sweepstakes (the "Sweepstakes") is open only to legal residents of the United States, 21 years of age or older at the time of entry. Employees of CityFarm Music, LLC (the "Sponsor"), their affiliates, subsidiaries, franchisees, representatives, advertising agencies and their immediate family members are ineligible to participate in the Sweepstakes. This Sweepstakes is void where prohibited by law.
(2) HOW TO ENTER AND PLAY:
(a) The contest begins at 12:01 a.m. PST on June 3, 2003 and ends at 11:59 p.m. PST on August 31, 2003 (the "Sweepstakes Period"). To participate in the Sweepstakes, each Sweepstakes entrant ("Entrant") must either: (1) visit Cindy Diane's website at www.cindydiane.com and complete and submit an online entry form during the Sweepstakes Period; or (2) mail an entry form postmarked by August 31, 2003 in the form of a 3X5 card to the following address: Cindy Diane "Face To Face In The Beautiful Bahamas" Sweepstakes, c/o CityFarm Music, LLC, P.O. Box 1492, Agoura Hills, CA 91376. Each completed entry form (the "Entry") must contain the Entrant's first and last names, date of birth, complete address (including street address, city, state and ZIP code), telephone number where he/she can be reached, and e-mail address, if any. Only one (1) Entry per person will be accepted. Each online Entrant must have an Internet or online service provider account in good standing with either free Internet access or a flat-monthly fee structure as of June 3, 2003. Each online Entry must be made by an individual from a single computer and may not be made by proxy, automated device(s) or electronic means such as script, bot, macro or any other similar software or program. Each online Entry will be deemed made by the registered owner of the e-mail address from which the Entry was received. All Entries must be received during the Sweepstakes Period; once submitted, all Entries are the property of CityFarm Music, LLC and will not be returned.
(b) On or around September 1, 2003, CityFarm Music, LLC will conduct a random drawing from all eligible Entries to select one (1) Grand Prize Winner (the "Winner"). The Winner will be notified by telephone and/or e-mail. CityFarm Music, LLC will make no more than two (2) attempts to notify the Winner. If the Winner does not respond to CityFarm Music, LLC's notification within 48 hours, CityFarm Music, LLC, in its sole discretion, may disqualify the winner and may or may not select an alternate winner by conducting a random drawing from all remaining correct and eligible Entries.
(3) PRIZE:
One (1) Grand Prize ("GP"): One (1) seven (7) night trip for two (2) people from a major international airport near the GP Winner's residence to the Bahamas, consisting of round trip airline tickets for two (2) people, coach class, from a major international airport near the GP winner's residence to the Bahamas, and a Hotel Pass for seven (7) nights' accommodation in a double occupancy room at a hotel in the Bahamas. The Hotel Pass expires on May 5, 2004. Hotel stay is subject to availability, with blackout dates including four (4) days before and after all major holidays. Use of the Hotel Pass requires 30 days' advance notice to CityFarm Music, LLC. The GP Winner and his/her guest must travel together, and the GP Winner's guest must be 18 years of age or older at the time of travel. Air travel must be pre-scheduled for use with the Hotel Pass, and must be completed no later than May 5, 2004, and is subject to the designated carrier's holiday and other blackout dates and other carrier restrictions. The airline tickets awarded as part of the GP cannot be upgraded and do not qualify for frequent flyer mileage. The GP Winner is responsible for obtaining all necessary travel documentation including passports and visas. Departure and airport taxes and customs/agriculture fees are not included as part of the GP and are the GP Winner's responsibility. The GP Winner is responsible for all expenses, costs and fees (including travel insurance) not explicitly listed as part of the GP. All fees and reporting requirements associated with federal, state and local taxes are the sole responsibility of the GP Winner. The Sponsor has sole discretion to designate and/or modify the airline, hotel room, and all other details of the GP not specifically listed above. The total approximate retail value of the GP is $4,310.00 (may vary depending on the dates of travel and originating flight location).
No substitutions are allowed for the GP, except that the Sponsor may, in their sole discretion, substitute a prize package of equal or greater value. The GP Winner may waive his/her right to receive their prize; however, their prize is nonassignable, nontransferable, and not redeemable for cash. Along with the GP, CityFarm Music, LLC will send a publicity consent, indemnification and affidavit of eligibility to the Winner and the Winner's guest; by accepting the GP, the Winner and the Winner's guest agree to complete, sign and return these documents no later than ten (10) days after receipt of their prize. Failure to sign and return the consent, indemnification and affidavit may, at the sole discretion of CityFarm Music, LLC result in the Winner's disqualification and the award of the prize to an alternate winner.
(4) ODDS:
The odds of winning depend on the number of eligible Entries received.
(5) PARTICIPATION:
Participation in this Sweepstakes constitutes an agreement by each Entrant to comply with all terms, provisions and conditions of these Official Rules. Entrants further agree to be bound by the terms relating to the use of the Cindy Diane website, including its Privacy Policy. Entrants also authorize the Sponsor to use their name, voice, likeness, biographical data and city of residence in programming or promotional material without further compensation, unless prohibited by law. The Sponsor reserve the right to disqualify Entrants found tampering with or otherwise abusing any aspect of this Sweepstakes as solely determined by Sponsor.
(6) SPONSOR'S RESERVATION OF RIGHTS:
If for any reason the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, integrity or proper conduct of the Sweepstakes, the Sponsor reserve the right, in its sole discretion, to modify, cancel, suspend or terminate the Sweepstakes.
(7) DISCLAIMER AND RELEASE:
By entering into the Sweepstakes or accepting or using any prize award or benefits, each Entrant releases the Sponsor and each of their affiliated companies, directors, officers, employees, parent companies, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Sweepstakes or with the acceptance, possession or use of the prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light). The Sponsor disclaim any liability for: (1) any error, omission, interruption, deletion, defect, delay or failure in the destruction or unauthorized access to or alteration of Entries; (3) any problems or technical malfunctions of any computer hardware, software, networks, lines, online systems, providers or servers associated with or used for the Sweepstakes, whether originating from Entrants, Sponsor or others; (4) failure of any Entry to be received during the Sweepstakes Period on account of traffic congestion or technical problems on the Internet or at any website, or any combination thereof; (5) any incomplete, inaccurate, illegible, garbled, defective, misdirected or misrouted Entries; (6) any injury or damage to any materials for this Sweepstakes; (7) any disputes, claims, damages, fees, costs, injuries or damages associated with or involving the use of the Prize; (8) any closure or other unavailability of the hotel in the Bahamas; or (9) any delay or cancellation of the flight to the Bahamas designated as part of the GP.
(8) CONSTRUCTION:
All questions, issues, claims and disputes concerning the construction, validity, interpretation and enforceability of these Official Sweepstakes Rules, or the rights and obligations of any Entrant, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than California.
(9) SPONSOR:
The Sweepstakes is sponsored by CityFarm Music, LLC. The Sponsor's decisions regarding the selection of the Winners and all other aspects of the Sweepstakes shall be final and binding in all respects. The Sponsor will not be responsible for any typographical, printing or other inadvertent errors in these Official Sweepstakes Rules or any other materials or administration relating to the Sweepstakes.
